Fanboy and Goth Girl’s “Third Thing” Essay Contest

PLEASE NOTE!!! IF YOU ARE UNDER 13 YEARS OLD, YOU MUST ENTER BY SNAIL MAIL!
Entrants who are under 13 years of age must mail their entries along with a signed note from a parent or legal guardian giving permission for the entrant to enter the contest and to be contacted by FanboyandGothGirl.com in the event of winning. Snail mail entries should be sent to: FanboyandGothGirl.com, 1418 Baltimore Street, Hanover, PA 17331.

NO PURCHASE NECESSARY. The “Third Thing” contest is sponsored by FanboyandGothGirl.com, 1418 Baltimore Street, Hanover, PA 17331 (“Sponsor”). Open only to legal residents of the 50 United States and the District of Columbia and Canada (except residents of the province of Quebec) who are 21 years old or younger at time of entry (“Entrants”). Employees of Sponsor and each of Sponsor’s affiliates, parent companies and subsidiaries, distributors, sales representatives, advertising and promotion agencies and the immediate family members and/or those living in the same household of each of the foregoing are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law.

TO ENTER: Submit an original essay of 100 words or less explaining what you think Fanboy’s “third thing” is and why. All entries must include the writer’s name and e-mail address. One (1) entry per person. Each entry must be an original, non-published work written in English. Entrant subject to all notices posted online, including but not limited to Privacy Policy. Once submitted, all entries become the property of the Sponsor and none will be acknowledged or returned. Incomplete entries and entries not complying with all rules are subject to disqualification. Enter via postal mail or electronically. Contest begins on January 12, 2007 and ends at 11:59 P.M. Eastern Time on February 15, 2007.

JUDGING: Entries will be judged on the following criteria worth 50% each of the overall score: (a) Originality of entry and (b) Creative expression. Entries will be judged by representatives of FanboyandGothGirl.com whose decisions are final in all respects.

WINNER NOTIFICATION: Sponsor will notify winners on or about February 18, 2007 by the e-mail address provided with the entry form. The Winner (and, if the Winner is a minor, the Winner’s parent or legal guardian) will be required to sign and return an Affidavit of Eligibility, Liability, and Publicity Release. If all of the required documentation is not returned within ten (10) days of notification attempt or if prize notification letter is returned as undeliverable, the prize may be forfeited and an alternate Winner selected.

PRIZE: One (1) prize winner will win either an iPod shuffle, iPod nano, or iPod, depending on number of entries. (up to 50 entries, prize is iPod shuffle; 51-100, iPod nano; 100+, iPod). Approximate retail value of prizes is between $79 and $249m depending on number of entries. No transfer, cash or prize substitution is permitted, except that Sponsor reserves the right to substitute a prize (or prize component) of equal or greater value for any reason.

GENERAL RULES & LIMITATIONS: By entering, Entrant grants to Sponsor the right to publish, edit, promote, and otherwise use the Entrant’s entry — including but not limited to name, essay and other information provided in the entry — in any and all media without further permission, notice or compensation, except where prohibited by law. The Winner shall be required to grant in writing to Sponsors the right to use his or her name, essay and other information provided by Entrant’s registration and entry in any and all media without further permission, notice or compensation, except where prohibited by law. By entering, Entrant represents and warrants to the Sponsor that: (1) the entry is the Entrant’s original work and (2) the entry does not and will not infringe upon or violate the rights of any third party. By participating in the Contest, Entrant agrees to release Sponsor and its parent, affiliates, subsidiaries, licensees, employees, officers, directors, shareholders, representatives, agents and advertising, promotional or judging agencies, or prize supplier from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, misuse, loss or misdirection of any prize, or while preparing for, participating in, and/or traveling to or from any contest or prize related activity.

Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Contest.

In the event of a dispute over the identity of an online Entrant, entry will be deemed submitted by the “Authorized Account Holder” of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic computer hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination therefore, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participating in the Contest. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to select Winner from eligible entries received as of the termination date.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
